Article 1 – General information

The present general conditions of sale and use of the company "Private Surfshop" define the rights and the obligations of the parts within the framework of the sale of products and the services by Private Surfshop. So, the customer must necessarily have acquainted with it and accept without reserve the full rights and the obligations. Any registration online implies this acceptance.
Private Surfshop makes a commitment to respect the present conditions. The present general conditions of sale come into effect from validation by the member of its registration and it for duration necessary for the sale of possessions and service by Private Surfshop. These can be modified at any time by Private Surfshop. The general applicable conditions of sale are the ones on-line on the web site, in the date of order.


Article 2 - Identification of the company
PRIVATE SURFSHOP is a french company with responsibility limited (SARL) which organizes private sales of products of famous board sports brands with a preferential prices.
PRIVATE SURFSHOP: LIMITED COMPANY with a capital of 1€, registered to the commercial register of Montpellier N 499 743 516 00019, the head office is situated in MONTPELIER ( 34080 ), N B1, Résidence le Pré Vert, 113 Rue Paul Choulot.


Article 3 – Terms indication

"Private Surfshop" indicates all the on-line services given to his members. "Member" indicates every person having filled the form of registration to be a part of Private Surfshop. "The site " indicates the web site identified by the url index: www.private-surfshop.com and of all the secondary pages.

Article 4 - Registration
The registration to Private Surfshop is free. To become member, every person has to fill the registration form and accept the general terms and conditions of sales of Private Surfshop. From then on subject to acceptance of Private Surfshop, the new member can then reach sales by entering its login and password and will receive the invitations by e-mail.

Article 5 - Description and information about products
Products are presented to the customer as a rough guide in the form of product sheet containing photos as well as the characteristics of the product. This information is given by the product suppliers. Private Surfshop makes a commitment to make the best presentation of the products but its responsibility would not be engaged in case of error in the descriptions. Photos and texts are not contractuals.

Article 6 - Stocks
Products are available upon availability. Private Surfshop declines any responsibility in case of shortage of stock. Private Surfshop thus makes a commitment to honor as much as possible all the orders received within the limits of available stocks. In case of unavailability, if the payment was already collected, Private Surfshop will make a refund to the customer as soon as possible.

Article 7 – Way of order
 
The order is made on-line on www.private-surfshop.com only. Only the persons legally able of signing contracts concerning the products and the services proposed on the site can order on-line. The customer makes a commitment to supply true and up to date information allowing Private Surfshop to make the follow-up of the order.
Private Surfshop would Private Surfshop declines any responsibility in case of incomplete or erroneous delivery address. The customer will again have to pay the delivery charges allowing Private Surfshop to deliver again the product to the new address if the order was not lost. Every customer engages his responsibility by any order made with his login and password.

Article 8 - Price
The prices are shown in euro TTC, delivery expenses should be added to the product price and are valid during their duration of display. Prices can be modified at any time without advance notice. The price of comparison is the advised selling price given by the supplier. In case of error of display, Private Surfshop makes a commitment to warn the customer, this one will then choose if he wishes to cancel his order without any added fees. Article 8.1 - Coupon of reduction
All our coupons of reduction or promotional codes are valid from 40 Euros of purchase, validl one month from the date of distribution except special mention.
Article 9 - Payment
The payment of the order has to be made on-line by bank card only. The member guarantees that he is authorized to use the bank card, that he has authorizations as well as sufficient capital to settle its order. Any order will be honoured by Private Surfshop only after validation of the payment. Private Surfshop can cancel any order in case of refusal of authorization of payment by accredited bodies or for not payment, as well as any order emanating from a member with which there would be a dispute. To assure member a maximal security and avoid the frauds, Private Surfshop can ask to his members to supply documents. The order will be validated only after reception of these documents.
In the case of not reception of these documents within 48 hours, Private Surfshop can cancel the order. Private Surfshop set up a system of reassurance of type encoding SSL.
The delays of invoicing are generally of 24 hours maximum, from once the payment validated. Beyond this delay, delivery charges cannot be refunded and will thus stay chargeable to the customer.

Article 10 - Modalities of delivery
Products will be delivered to the address indicated by the Customer when filling the form. Private Surfshop delivers everywhere in Europe and Switzerland. The delivery delay is about 30 days calendar except special mention. These delivery periods are given as a rough guide and correspond to average delays of treatment and delivery of the orders.
An advice of send is sent by e-mail to the address indicated in its personal information. In the column " My Account ", the customer can follow the state of his order from order to delivery. The delivery is assured by post or by a carrier; it is advisable to Private Surfshop to choose the best means according to the specificities of the order. Private Surfshop recommends to his customers to give a delivery address where they will be present at the working hours to receive the order.

Article 10.1 - Delivery by post
The tracking of the order can be made on www.coliposte.net with the tracking number given on line in the space "my account ". The delays are approximately from 2 to 5 days since the reception of the notice of expedition sent by e-mail. In case of absence in the daytime of the delivery, the factor will put deposit a calling card, the customer has then a period of 10 days to take his order to the post office indicated on the card. Beyond this period the order will be sent back to Private Surfshop. the expenses of forwarding will be chargeable to the customer.
And if in 5 working days after the reception of the e-mail the order was till not delivered it is advisable to the customer to inquire with the post office the closest to the place of delivery.

Article 10.2-Delivery by a carrier
The delays are approximately from 2 to 3 days from the reception of the announcement of sending by e-mail warning of the sending. If the person is not present to receive the order at the delivery address, the carrier will leave a phone number to join him and agree of another delivery date. Without news of the customer, the order will be sent back to Private Surfshop

Article 10.3 - Problems of delivery because of the carrier
On reception of the delivery, the customer has to unpack the product in the presence of the carrier and thus to verify the products before signing the delivery order. In case of abnormality, the customer has to indicate the possible damages in a way explicit, detailed and dated on the delivery order and warn Private Surfshop of it by registered letter with acknowledgement of receipt within 3 working days. The customer will absolutely have to refuse the deliver. Any complaint made outside this period or not respecting the description above cannot be taken into account by Private Surfshop. The delivery is considered delivered by Private Surfshop when accepted by the customer.

Article 10.4- Particular Cases
In the case of exceptionally voluminous products the Customer is anxious to make sure beforehand that the main access to its place of residence - notably the dimension of its stairwell and its front door - allow the delivery of its order. Should the opposite occur, the Customer cannot be delivered by his order to his place of residence and new delivery charges will stay at his expense.

Article 10.5 - right of retraction
According to the article L 121-20 of the Code of the Consumption, the customer has a period of 7 days further to the reception of the order. This right practices by sending back products, expenses and risks of delivery back are chargeable to the customer. Private Surfshop will make the refund of the order except delivery charges. This power of retraction cannot be valid if products have been used or if there are returned incomplete, without the original packing or damaged. Products must necessarily be returned to a state appropriate for the resale (exact state of origin, in their original packing, with all the inclusive, not damaged accessories, the notes or the documentation, damaged or made dirty by the customer) accompanied with the invoice of sale. Article 10.6 - Error of delivery
In the case of not corresponding order, the customer will have 48 hours to contact Private Surfshop by e-mail at retour@private-surfshop.com mentioning the error or the non-compliance of the order. Beyond this delay, any complaint will be rejected. Private Surfshop will attribute after acceptance of return a number of return as well as an address of return.
Then, the customer will have a period of 7 working days to send the order attached with the invoice to Private Surfshop in the state mentioned in the previous article by clarifying his number of return on the address.

Article 11 - Protected from products
In case of products not corresponding to the information given during their presentation onto the website, products will be paid off or replaced upon avalability and the choice of the customer. In that case the expenses of return are chargeable to Private Surfshop only if the member supplied a documentary evidence of the committed expenses. Private Surfshop will give a purchase voucher.
Private Surfshop is not the manufacturer of products, it is intermediate. The manufacturers they even guarantee products put on sale on Private Surfshop, only their responsibility can be looked for in case of defective product. The customer will thus have to address directly the service after sale of the supplier. Guarantees are mentioned in the product sheet during the sale.

Article 12
Private Surfshop wouldn’t be responsible in case of shortage of stock, of force, fortuitous or not, disaster, fire, partial or total disturbance, notably burdens postal services or technical failure of its site, any event not allowing it to handle an order. 

Article 13 - applicable right - Jurisdiction
The general conditions of sale of Private Surfshop are interpreted according to the French law. In case of dispute on their interpretation, the member and Private Surfshop makes a commitment to do their best to settle the amicable dispute. For lack of an agreement, the courts of Montpellier, will be the only competent whatever is the place of delivery is. In the hypothesis where one of the measures of the general conditions would be considered as illegal or non-invocable by a decision of justice, the other  will keep their contractual character.

Article 14 - Responsibility
The responsibility of Private Surfshop cannot exceed a sum equal to the paid or payable sums during the transaction at the origin of the aforementioned responsibility, whatever is the cause or the shape of the concerned action.
